This document applies to TOKK™ across all platforms, including mobile applications (iOS, Android), websites, wearable devices, connected TVs, embedded systems, and future platforms.

1. Acceptance of Terms

By accessing or using TOKK™ services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

2. Service Description

TOKK™ is a movement, fitness, and wellness coaching service. It is not a medical service.

TOKK provides personalized coaching and guidance in the areas of movement, physical fitness, sleep optimization, nutrition, and mental wellness. Our AI-powered coaching is designed to support your general health and wellness goals through evidence-based practices and personalized recommendations.

Medical Disclaimer

TOKK is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The coaching, information, and recommendations provided through TOKK:

• Do not constitute medical advice
• Are not a substitute for professional medical care, diagnosis, or treatment
• Should not replace consultation with qualified healthcare providers
• Are not intended for use in medical emergencies

User Responsibilities

Before beginning any fitness or wellness program through TOKK, you should:

• Consult with your physician or qualified healthcare provider, particularly if you have any pre-existing medical conditions, injuries, or concerns
• Seek immediate medical attention if you experience chest pain, dizziness, severe shortness of breath, or other concerning symptoms during exercise
• Inform your healthcare providers about your use of TOKK and any wellness practices you adopt through the service

Scope of Coaching

TOKK provides guidance on:

• Exercise programming and movement patterns
• Sleep hygiene and recovery practices
• General nutritional principles and healthy eating habits
• Stress management and mental wellness techniques
• Fitness goal setting and progress tracking

TOKK does not and cannot:

• Diagnose medical conditions or injuries
• Prescribe medications or medical treatments
• Provide medical nutrition therapy for diagnosed conditions
• Offer treatment for mental health disorders
• Replace care from licensed physicians, physical therapists, registered dietitians, or mental health professionals

Emergency Situations

TOKK's emergency alert feature is designed to notify your designated contacts in case of a wellness emergency during a workout or coaching session. This feature:

• Is not a substitute for emergency medical services (911 or your local emergency number)
• May experience delays or technical failures
• Should be used in conjunction with, not instead of, calling emergency services when needed

3. Eligibility

You must be at least 18 years old to use TOKK™. Health Disclaimer & Assumption of Risk Physical activity involves inherent risks. You assume all risks associated with using TOKK™.

4. Accounts

You must create an account to use TOKK™. You are responsible for safeguarding your account credentials.

5. Subscriptions & Payments

Subscriptions may be processed through Apple, Google, or authorized payment providers. TOKK™ does not store payment card data.

6. Acceptable Use

You may not misuse the service or access systems unlawfully. You agree not to use TOKK Services to:

1. Infringe on intellectual property rights of others
2. Transmit harmful, threatening, or abusive content
3. Attempt to gain unauthorized access to our systems
4. Interfere with or disrupt the Services
5. Use the Services for any commercial purpose without authorization
6. Reverse engineer, decompile, or disassemble any part of software
7. Remove or modify any proprietary notices or labels

7. Intellectual Property

All TOKK™ content and software are protected by intellectual property laws.

1. Our property: All content, features, and functionality of TOKK, including but not limited to software, hardware design, text, graphics, logos, and trademarks, are owned by TOKK AI, Inc. and are protected by copyright, trademark, and other intellectual property laws.
2. Your Content: You retain ownership of any content you provide to TOKK. By using our Services, you grant us a limited license to use, process, and store your content solely for the purpose of providing and improving our Services.

8. Termination

TOKK™ may suspend or terminate access for violations.

9. Limitation of Liability

TOKK™ is not liable for injuries, health outcomes, or indirect damages.

California law governs these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
